Java – I can’t distribute JAXB closed code?

In http://jaxb.java.net/ It says JAXB's dual license includes CDDL v1 0 and GPL V2;

CDDL says:

Distribution obligations Availability of source code Any covered software that you may distribute in executable form or otherwise provide must also be provided in the form of "source code", and the "source code" form must be distributed only under the terms of this license

So I can't use JAXB without opening the code?

–update

"Any covered software you distribute";

1.3. "Overlay software" means (a) the original software, or (b) a modification, or (c) a combination of a file containing the original software and a file containing the modification, in each case including a portion thereof https://glassfish.dev.java.net/public/CDDL +GPL. html

The software I develop is not considered "a combination of files containing the original software and files containing modifications"?

Solution

You can use JAXB without open source code (if you follow other terms of CDDL) However, you cannot distribute JAXB itself

Update of response problem editor: assuming that your code is not a modification of JAXB and does not contain any part of JAXB, it will not be overwritten I'm not a lawyer. Use a grain of salt to my opinion
